Passenger Overloading

Passengers Are a Load
Everything Module 7 has said about cargo applies to people, because to the vehicle's physics a passenger is simply weight — roughly 62–75 kg of it, per person, that the brakes, tyres, and stopping distances must account for. An extra ten passengers is over half a tonne of load the vehicle wasn't stopping-distance-tested with (Lesson 7.2).
But passengers differ from cargo in two ways that make overloading worse, not better:
- They sit high, and some stand. Passenger weight rides well above the load bed — a high centre of gravity that worsens roll (Lesson 7.3.3's "heavy low" rule, violated by design), and standing passengers in an overcrowded PSV raise it further.
- They're unsecured and unsecurable beyond seatbelts. A cargo load can be strapped to meet the 80% forward-force rule (Lesson 7.3.1); a standing or over-squeezed passenger cannot be. Under a hard stop, they carry that same 80%-of-bodyweight forward force into whatever — or whoever — is in front of them.
So a passenger isn't a gentler load than cargo; it's a load you can't secure properly, sitting higher than you'd ever place cargo. The physics of Lesson 7.2 doesn't soften for being human — it sharpens.

Your Legal Capacity Is a Fixed Number
Every PSV has a licensed carrying capacity — a specific maximum number of passengers, displayed on the vehicle (on the licence disc / statutory markings) and recorded in its PSV licensing. It is not a target to be exceeded when demand is high or a guideline to be stretched at peak hours: it's a legal ceiling, set from the vehicle's seating, weight limits, and safety design.
The connection to the rest of the module: that capacity number is a payload calculation (Lesson 7.1) expressed in people. The manufacturer and licensing authority worked back from the vehicle's GVW, seating, and safety systems to a number of persons — so exceeding the passenger count is exceeding the payload, with all of Lesson 7.2's consequences, plus the seatbelt/seating law. Modern PSV rules also require a seatbelt for each passenger and, by extension, a seat — which standing-passenger overcrowding structurally cannot provide.

Like cargo overloading (Lesson 7.4.3), passenger overloading spreads liability — because the driver at the wheel and the operator/owner running the route both shape the decision to overcrowd:
- The driver is responsible for not carrying more than the licensed capacity and for the safety of those aboard.
- The operator/owner (and the SACCO or company under which the PSV runs) carries responsibility for the operating conditions that pressure overcrowding — schedules, revenue targets, route practices.
This dual liability mirrors the owner-and-driver structure of cargo law and exists for the same reason: penalising only the driver leaves untouched the commercial pressure that actually drives overcrowding. It connects directly to Lesson 6.3's PSV zero-alcohol rule — both are cases where the law holds PSV drivers and the system around them to a stricter standard, precisely because of how many lives ride on the outcome.
The Physics of an Overloaded Matatu
Make it concrete. Take a 14-seat matatu carrying 20+ people (a real, common overload):
- Stopping distance: six-plus extra adults is roughly 400–450 kg of unplanned load — the braking-distance penalty, applied to a vehicle already often on worn tyres and marginal brakes. The stop the driver's instincts expect is not the stop the overloaded vehicle delivers.
- Centre of gravity: passengers packed in and standing raise the CoG, worsening roll in the swerve or the roundabout — a matatu's characteristic loss-of-control mode.
- Tyres: the extra weight over-stresses tyres toward the heat-and-blowout failure, on vehicles that run long hard days.
- Egress in a crash: an overcrowded cabin is one nobody can get out of quickly when it matters most — a consequence with no cargo equivalent.
None of this is unique physics — it's Lesson 7.2 with people as the load. Which is the point: the matatu overloaded by six passengers is subject to the exact braking, handling, and tyre penalties that would fail a lorry weighbridge, just measured in fares instead of tonnes.

The hierarchy says the more harm your vehicle can do, the more responsibility you carry — and a PSV concentrates the most lives behind one driver's decisions of any vehicle on the road. An overloaded matatu doesn't just endanger other road users (the usual hierarchy case); it endangers the twenty-plus people who have handed the driver their safety directly.
That's why PSV drivers sit at the strict end of every rule in this platform — zero alcohol (6.3), fatigue-hours limits (6.4), licensed-capacity limits (here). The passengers can't check the brakes, can't judge the driver's fatigue, can't verify the tyre pressures; they've delegated all of it. Respecting the capacity limit isn't bureaucratic compliance — it's honouring a delegation of trust that the hierarchy of responsibility says falls squarely, and heavily, on the driver and operator.
The Durable Rule Beneath the Reality
Current context (worth updating as conditions change): passenger overcrowding on Kenyan PSVs — matatus and buses carrying well past licensed capacity, especially at peak hours, on rural routes, and where enforcement is thin — is a widespread current reality, driven by fare economics and demand outstripping supply. NTSA enforcement, SACCO regulation, and cashless-fare systems that record passenger numbers are all pressures pushing against it, with uneven results. If capacity compliance improves substantially, this callout ages out.
